Terms of Use

1. Scope

These Terms of Use (hereinafter "TOU") govern access to and use of the TokRouter platform, a project created by AI enthusiasts owned and published by PinStudio, based in Switzerland (hereinafter "TokRouter" or "the Service").

Access to and use of the Service are subject to unconditional acceptance of and compliance with these TOU. By creating an account or using the Service, the user (hereinafter "the User" or "you") acknowledges having read and fully accepted the TOU.

TokRouter reserves the right to amend these TOU at any time. Amendments take effect upon publication on the Site. Users are advised to consult this page regularly.

2. Account Creation

To access the Service's features, the User must create an account by providing a valid email address and a secure password. The information provided during registration must be accurate, complete, and kept up to date.

The User is solely responsible for maintaining the confidentiality of their login credentials. Any activity carried out through their account is deemed to have been performed by the User themselves. In the event of unauthorized use of their account, the User undertakes to notify TokRouter without delay.

TokRouter reserves the right to refuse or suspend a User's registration in the event of non-compliance with these TOU or the provision of manifestly inaccurate information.

3. User Obligations

The User undertakes to use the Service in compliance with applicable laws and regulations, and in particular not to:

  • Use the Service for fraudulent, unlawful, or public-order and decency-violating purposes;
  • Infringe the intellectual property rights of TokRouter or third parties;
  • Attempt to access unauthorized areas of the Service or circumvent implemented security measures;
  • Use the Service to transmit viruses, Trojan horses, or any other malicious code.

4. Prohibited Uses

When using the artificial intelligence models accessible via the Service, it is strictly prohibited to:

  • Generate illegal, hateful, discriminatory, violent, pornographic, or harassing content;
  • Generate content intended to deceive or impersonate a third party (deepfakes, disinformation);
  • Use the Service to develop autonomous weapon systems, mass surveillance tools, or any application infringing fundamental rights;
  • Exploit the Service for reverse engineering of underlying models or for training competing models;
  • Exceed reasonable rate limits or attempt to saturate the infrastructure of TokRouter or its providers.

TokRouter reserves the right to immediately suspend or terminate any account that fails to comply with these prohibitions, without notice or refund.

5. Intellectual Property

TokRouter is the exclusive owner of intellectual property rights relating to the Site, the Service, its source code, graphic elements, visual identity, texts, and database. Any unauthorized reproduction, representation, adaptation, or exploitation is prohibited.

Content generated by the User via the AI models (hereinafter "Generated Content") remains the property of the User. However, the User grants TokRouter a non-exclusive, royalty-free, worldwide license to use such Generated Content solely for the purposes of providing and improving the Service.

TokRouter's trademarks, logos, and trade names are protected marks. Any use without prior written authorization is prohibited.

6. Service Availability

TokRouter endeavors to keep the Service accessible 24 hours a day, 7 days a week, but cannot be held liable for temporary interruptions due to maintenance operations, technical failures, force majeure events, or failures of its third-party providers (including model and cloud infrastructure providers).

TokRouter reserves the right to interrupt the Service for scheduled maintenance operations, wherever possible with reasonable prior notice to Users.

7. Limitation of Liability

Important

To the fullest extent permitted by applicable law, TokRouter shall not be held liable for:

  • AI-generated content: the artificial intelligence models are provided by third parties. TokRouter exercises no control over the content, accuracy, relevance, or legality of generated responses. The User is solely responsible for their use of Generated Content;
  • Indirect damages: data loss, loss of revenue, loss of clientele, reputational harm, lost profits, or any other indirect prejudice resulting from the use or inability to use the Service;
  • Service interruptions: whether due to technical failures, maintenance operations, cyberattacks, or the unavailability of third-party APIs;
  • Loss of credits: in the event of account deletion, subscription termination, or technical failure, unused credits shall not give rise to any refund, unless otherwise required by law.

In any event, TokRouter's liability is limited, for all combined damages, to the total amount paid by the User during the twelve (12) months preceding the event giving rise to liability.

Nothing in these TOU shall have the effect of excluding or limiting TokRouter's liability in the event of fraud, willful misconduct, personal injury or death resulting from negligence, or to any other extent prohibited by applicable law.

8. Third-Party Services

The TokRouter Service relies on third-party services, including:

  • AI model provider: API requests and chat conversations are transmitted to a processing provider in order to provide Service responses;
  • Stripe: payment service provider. Financial transactions are processed exclusively by Stripe. TokRouter does not store full banking data;
  • Hosting provider: the Service is hosted by a cloud infrastructure provider. TokRouter does not guarantee the absence of failures by this host.

TokRouter disclaims all liability regarding the content, practices, or availability of third-party services. Users are encouraged to review the terms and privacy policies of these services.

9. Termination

The User may terminate their account at any time from their account settings or by contacting support. Termination takes effect immediately; remaining credits are forfeited.

TokRouter may terminate or suspend a User's account without notice in the event of a serious breach of these TOU, in particular in the case of unlawful use of the Service or non-payment. Termination does not entitle the User to any refund of amounts already paid.

10. Applicable Law

These TOU are governed by Swiss law. In the event of a dispute relating to the interpretation, performance, or validity of these terms, the Swiss courts shall have exclusive jurisdiction.

11. Dispute Resolution

In the event of a dispute, the User is invited to first contact TokRouter at the address indicated in Article 12 in order to seek an amicable resolution.

In accordance with Regulation (EU) No. 524/2013, the European Commission provides an online dispute resolution platform accessible at: https://ec.europa.eu/consumers/odr/.

Consumer Users residing in France may also have free recourse to a consumer ombudsman within one year of the written complaint addressed to TokRouter.
